Driving and Rest Times: Overview

HGV drivers are governed by stringent regulations regarding driving and rest periods. The latest ruling on this matter was passed in 2007: Regulation 561/2006. In the UK, this regulation is incorporated into specific British legislation known as the ‘Working Time Regulations (Road Transport)’.

AETR Regulations

The regulations for driving and rest periods detailed in the directive apply to all trips within the European Union. If the destination of a journey is in any of the following countries, then the AETR rules apply:

Albania, Andorra, Armenia, Azerbaijan, Bosnia/Herzegovina, Kazakhstan, Croatia, North Macedonia, Moldova, Montenegro, Ukraine, Uzbekistan, Russia, Serbia, Turkey, Turkmenistan, and Belarus.

Example 

An illustration will best demonstrate the application of the AETR rules: a lorry driver in Birmingham is instructed to collect a consignment in Milan. During a stopover, the journey is altered and the driver is directed to pick up a load in Moscow (Russia). The AETR regulations now apply for the entirety of the trip (from Birmingham to Moscow). If one or more journeys under the AETR Agreement are made within a week, the rules for weekly and fortnightly driving and rest periods stipulated in the AETR Agreement are enforced for that duration.
